Refund Policy

1. Scope

This Refund Policy applies to all services provided by HelixCoreSystems, headquartered at Calle de Velázquez 48, Madrid, Salamanca, España. It governs all digital services including web development, UI/UX design, performance optimization, cloud deployment, SEO audits, and CMS integration.

2. Project Milestone Refunds

Services are delivered in clearly defined project milestones. Refunds are evaluated proportionally based on completed and pending milestones:

  • Before project initiation: If you cancel before any work has commenced, you are entitled to a full refund of any advance payment within 14 business days.
  • During early-stage milestones (SYSTEM_DIAGNOSIS, ARCHITECT_RENDER): A partial refund may be issued, deducting the proportional cost of completed discovery and planning work.
  • During active development (BUILD_EXECUTE): Refunds will be calculated based on remaining unstarted milestones. Completed sprint work is non-refundable.
  • Post-deployment (DEPLOY_OPTIMIZE): No refunds are available for services that have been fully delivered and deployed to production, unless a material defect is identified within 30 days of handover.

3. Material Defect Claims

If a delivered service contains a material defect — defined as a functionality that does not conform to the agreed-upon project specification — you must notify us in writing within 30 days of delivery. We will rectify the defect at no additional cost within a reasonable timeframe. If rectification is not possible, a proportional refund will be issued.

4. Non-Refundable Items

  • Third-party license fees, hosting costs, or domain registration fees incurred on your behalf.
  • Work completed under a change request (scope expansion) that was approved in writing.
  • Services rendered free of charge or as part of a promotional offer.

5. Refund Process

To request a refund, contact us at [email protected] with your project reference and a description of the basis for your refund request. We will acknowledge receipt within 3 business days and provide a determination within 14 business days.

Terms of Service

1. Acceptance of Terms

By engaging the services of HelixCoreSystems, located at Calle de Velázquez 48, Madrid, Salamanca, España, you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.

2. Scope of Services

HelixCoreSystems provides digital services including but not limited to: web application development, UI/UX design, micro-animation engineering, headless e-commerce builds, performance optimization, cloud and DevOps deployment, SEO audits, and custom CMS integration. The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate written project agreement or statement of work (SOW).

3. Payment Terms

  • All prices are quoted in Euros (€) unless otherwise specified.
  • A 50% advance payment is required before project initiation, with the remaining 50% due upon project completion and client acceptance.
  • For projects exceeding €3,000, payments may be structured in milestone-based installments as agreed in the SOW.
  • Invoices are payable within 14 days of issue. Late payments may incur a statutory interest rate of 4% per annum plus a fixed recovery fee of €40, in accordance with Spanish commercial law.

4. Intellectual Property

Upon full payment of all outstanding invoices, all intellectual property rights in the deliverables — including source code, design assets, and documentation — are transferred to the client. HelixCoreSystems retains the right to display the work in its portfolio and marketing materials unless the client objects in writing. Third-party libraries, frameworks, and tools remain subject to their own open-source or commercial licenses.

5. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary information shared during the course of the engagement. This obligation survives the termination of the agreement for a period of 24 months.

6. Limitation of Liability

HelixCoreSystems shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services. Our total aggregate liability under any engagement shall not exceed the total fees paid by the client for the specific project giving rise to the claim.

7. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from causes beyond reasonable control, including but not limited to: acts of God, government regulations, war, terrorism, pandemic, natural disasters, internet outages, or third-party service failures.

8. Termination

Either party may terminate the agreement with 14 days' written notice. In the event of termination by the client, all completed work up to the termination date shall be delivered and compensated proportionally. Termination for material breach requires written notice and a 7-day cure period.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Spain. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Madrid, España.

10. Amendments

HelixCoreSystems reserves the right to amend these Terms of Service at any time. Material changes will be communicated via email or a prominent notice on our website at least 14 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the amended terms.
